  1. Doesn't Byte Software Software License Agreement
  2. Software Program:  Waste Whacker
  3.  
  4. IMPORTANT -  THIS IS A LEGAL AGREEMENT BETWEEN YOU (EITHER AN 
  5. INDIVIDUAL OR AN ENTITY) AND DOESN'T BYTE SOFTWARE. BY INSTALLING 
  6. AND/OR USING THE SOFTWARE, YOU ACKNOWLEDGE THAT YOU HAVE READ 
  7. THIS LICENSE AGREEMENT, UNDERSTAND IT, AND AGREE TO BE BOUND BY 
  8. ITS TERMS.  YOU FURTHER AGREE THAT IT IS THE FULL AND COMPLETE 
  9. AGREEMENT BETWEEN US, SUPERSEDING ALL PRIOR  WRITTEN OR VERBAL 
  10. AGREEMENTS OF ANY KIND. IF YOU DO NOT UNDERSTAND OR DO NOT 
  11. AGREE TO THE TERMS OF THIS AGREEMENT, YOU MUST CEASE USING THIS 
  12. PRODUCT IMMEDIATELY.

  14. 1.  GRANT OF LICENSE.  This License Agreement permits you to 
  15. use one copy of the above mentioned Doesn't Byte Software 
  16. software program (the "SOFTWARE") on a single computer.  The 
  17. SOFTWARE is in "use" on a computer when it is loaded into 
  18. temporary memory (i.e. RAM) or installed into permanent memory 
  19. (e.g. hard disk, CD-ROM, or other storage device) of that 
  20. computer.  However, installation on a network server for the 
  21. sole purpose of internal distribution shall not constitute 
  22. "use" for which a separate license is required, provided you 
  23. have a separate license for each computer to which the SOFTWARE 
  24. is distributed.

  26. 2.  COPYRIGHT.  The SOFTWARE is owned by Doesn't Byte Software or 
  27. its suppliers and is protected by United States copyright laws 
  28. and international treaty provisions.  Therefore, you must treat 
  29. the SOFTWARE like any other copyrighted material (e.g. a book 
  30. or musical recording) except that you may either (a) make one 
  31. copy of the SOFTWARE solely for backup or archival purposes, or 
  32. (b) transfer the SOFTWARE to a single hard disk provided you 
  33. keep the original solely for backup or archival purposes.  You 
  34. may not copy the written materials accompanying the SOFTWARE.

  36. 3.  OTHER RESTRICTIONS.  You may not rent or lease the 
  37. SOFTWARE, but you may transfer the SOFTWARE and accompanying 
  38. written materials on a permanent basis provided you retain no 
  39. copies and the recipient agrees to the terms of this 
  40. Agreement.  You may not reverse engineer, decompile, or 
  41. disassemble the SOFTWARE.  If the Software is an update or has 
  42. been updated, any transfer must include the most recent update 
  43. and all prior versions.

  45. Limited Warranty 
  46.  
  47. LIMITED WARRANTY.  This program is provided "as is" without any 
  48. warranty of any kind, either expressed or implied, including, 
  49. but not limited to, the implied warranties of merchantability 
  50. and fitness for a particular purpose.  The entire risk as to 
  51. the quality and performance of the SOFTWARE is with you, the 
  52. licensee.  Should the SOFTWARE prove defective, you assume the 
  53. risk and liability for the entire cost of all necessary repair, 
  54. service, or correction.  Some states/jurisdictions do not allow 
  55. the exclusion of implied warranties, so the above exclusion may 
  56. not apply to you.  This warranty gives you specific legal 
  57. rights, and you may have other rights which vary from 
  58. state/jurisdiction to state/jurisdiction.

  60. Doesn't Byte Software does not warranty the functions contained 
  61. in the SOFTWARE will meet your requirements, or that the 
  62. operation of the SOFTWARE will be error-free or uninterrupted.  
  63.  
  64. NO OTHER WARRANTIES.  To the maximum extent permitted by 
  65. applicable law, Doesn't Byte Software and its suppliers disclaim 
  66. all other warranties, either express or implied, including, but 
  67. not limited to, implied warranties of merchantability and 
  68. fitness for a particular purpose, with regard to the SOFTWARE, 
  69. the accompanying written materials, and any accompanying 
  70. hardware.  This limited warranty gives you specific legal 
  71. rights.  You may have others which vary from state/jurisdiction 
  72. to state/jurisdiction.

  74. NO LIABILITY FOR CONSEQUENTIAL DAMAGES.  To the maximum extent 
  75. permitted by applicable law, in no event shall Doesn't Byte 
  76. Software or its suppliers be liable for any damages whatsoever
  77. (including, without limitation, damages for loss of business
  78. profits, business interruption, loss of business information,
  79. or any other pecuniary loss) arising out of the use or 
  80. inability to use this Doesn't Byte Software product, even if 
  81. Doesn't Byte Software has been advised of the possibility of 
  82. such damages or for any claim by any other party.  Because some 
  83. states/jurisdictions do not allow the exclusion or limitation 
  84. of liability for consequential or incidental damages, the above 
  85. limitation may not apply to you.
